The terms and conditions contained herein along with the Privacy Policy form an agreement regulating our relationship with regard to the use of Btechguru.com for shopping by you, the user. You are advised to read this Agreement carefully. If you are not agreeable to any terms and conditions, you should not use the Services. You can use the Btechguru.com Services/Products if you are agreeable to all the terms and conditions of this Agreement in their entirety.
Applicable Law
This site is created and controlled by Btechguru.com in Chennai, India; as such the laws of India shall apply; courts in Chennai shall have jurisdiction in respect of all the terms, conditions and disclaimers and other policies mentioned on the site. Btechguru.com reserves the right to make changes to the site and the terms, conditions, disclaimers and other policies mentioned on the site.
Definitions: "Agreement" means the terms and conditions as detailed herein including all schedules, appendices, annexures, privacy policy, disclaimers, and will include the references to this Agreement as amended, novated, supplemented, varied or replaced from time to time.
"Btechguru.com"/ "Site" means the services offered through www.btechguru.com, which provides a venue to the users and members of www.btechguru.com to avail the services and buy the products listed or purchased on Btechguru.com.
"NPTEL" is National Programme for Technology Enhanced Learning, which is an initiative by the IITs and IISc.Btechguru.com/Bodhbridge is involved in the distribution of NPTEL material.
"Customer" / "Buyer" shall mean the person or any legal entity who accepts the offer for sale on Btechguru.com by placing an order for and or purchases any products offered for sale on Btechguru.com.
"User"/ "You" means and includes you and/or any person/visitor or an entity using or accessing the services provided on this Site.
"Member" means the person who has paid and is availing Btechguru.com membership. "Lifetime Member" has subscribed to such a Lifetime membership offered by Btechguru.com.
Eligibility:
You represent and warrant that You are competent and eligible to enter into legally binding agreement and have the requisite authority to bind Btechguru.com to this Agreement. You shall not use this Site if You are not competent to contract under the applicable laws, rules and regulations.
Term of Agreement/Service:
This Agreement shall continue to be in full force and effect for so long as You are using the Btechguru.com services. Btechguru.com provides the Services and online shopping platform wherein the Users can purchase/buy the products listed on Btechguru.com (the "Services") pursuant to the terms and conditions set forth below. By clicking on the [Close] button, You agree to use the Services in a manner consistent with the terms hereof and also agree abide by the terms and conditions of this Agreement, including but not limited to the privacy policy, and with all applicable laws and regulations. Either You or Btechguru.com may terminate the service at any time, with or without cause. However, Btechguru.com reserves the right, in its sole discretion, to terminate Your access to the Btechguru.com services and the related services or any portion thereof at any time, without notices.
Modification of Terms and conditions of Service:
Btechguru.com may at any time modify the terms and conditions ("Terms") of the Services without any prior notification to You. You can access the latest version of the Terms, which shall be updated regularly at the link on the website. You undertake to regularly review the Terms. In the event that the modified Terms are not acceptable to You, You shall immediately discontinue using the Services. However, if You continue to use the Services, You hereby agree to accept and be bound by the modified Terms.
Registration Data: To avail of and use certain Services provided, You shall have to register with Btechguru.com. As a part of registration process, You agree to provide Btechguru.com current, complete, and accurate registration information (the "Registration Data") as prompted to do by the Service and to maintain and update this information as required to keep it current, complete and accurate. Btechguru.com shall have the right verify the accuracy of such information provided by You.
If You provide any information that is untrue, inaccurate not current or incomplete or Btechguru.com has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Btechguru.com has the right to indefinitely suspend or terminate Your membership and refuse to provide You with access to Btechguru.com.
You shall be responsible for maintaining the confidentiality of Your password, which You will not be under an obligation to reveal to any representative or agent of Btechguru.com.
You agree and understand that Btechguru,com Services are supported by advertisements and therefore You grant Btechguru.com the right to disclose the aggregate Registration Data to third parties in connection with relevant marketing and other useful Services to you. Furthermore, You agree and grant Btechguru.com the right to use Your individual Registration Data to provide for targeting of advertisements and other service offers to You.
You shall notify to our customer support department of any known or suspected unauthorized use(s) of Your account, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of Your password.
Your Account and Registration Obligations
If you use the Website, you are responsible for maintaining the confidentiality of your User ID and Password and for restricting access to your computer, computer system and computer network, and you are responsible for all activities that occur under your User ID and Password.
You agree, inter alia, to:
Provide true, accurate, current and complete information about yourself as prompted by Btechguru.com’s User Registration form (such information being the "Registration Data")
Maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete or Btechguru.com has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the User Agreement Btechguru.com has the right to indefinitely suspend or terminate your membership with the Website and refuse to provide you with access to the Website.
Electronic Communications
When You use the Website or send emails or other data, information or communication to Btechguru.com, You agree and understand that You are communicating with Btechguru.com through electronic records and You consent to receive communications via electronic records from Btechguru.com periodically and as and when required. Btechguru.com will communicate with You by email or by an Btechguru.com notice or electronic records on the Website which will be deemed adequate service of notice / electronic record.
Fees and Services
User Registration on the Website is free. Btechguru.com does not charge any fee for User Registration which allows the User to access non-member Services of the Website. User Registration is mandatory for purchasing any item from the Website and for availing the use of the Website’s Online Payment Gateway. However, from time to time Btechguru.com offers ‘Btechguru Memberships’ that are priced according to the Btechguru.com norms announced on the Website. Btechguru.com reserves the right to change its fee and policies from time to time. In particular, Btechguru.com may at its sole discretion introduce new services and modify some or all of the existing services offered on the Website. In such an event Btechguru reserves the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be. Changes to the fee and policies shall be posted on the Website and such changes shall automatically become effective immediately after they are posted on the Website.
Unless otherwise stated, all fees shall be quoted in Indian Rupees.
Taxes: You are responsible for paying all fees associated with the use of the Website and you agree to bear any and all applicable taxes, charges etc. levied thereon.
Non-payment: Btechguru reserves the right to issue a warning, temporarily /indefinitely suspend or terminate your membership of the Website and refuse to provide you with access to the Website in case of non-payment of fees by you to Btechguru. Btechguru also reserves the right to take legal action in case of non-payment of fees by you to Btechguru .
Online Purchase of NPTEL Material and other Products/Service :
You agree, understand and acknowledge that Btechguru.com provides an online platform for purchase of NPTEL materials and other Products/Services, a venue enabling the Users to buy any product listed on Btechguru.com at the price indicated in connection with the product in question and/or any other terms and conditions indicated therein at any time from any place. You further agree and acknowledge that the NPTEL Material and other Products/Services sold on Btechguru.com have their own copyright agreements or other terms and conditions and you are bound by such terms when you purchase them.
Suspension due to non-compliance with Agreement:
Notwithstanding other legal remedies that may be available to Smartshoppers.in, Smartshoppers.in may in its sole discretion limit User activity by immediately removing User listing either temporarily or indefinitely or suspend or terminate User membership, and/or refuse to provide User with access to the Site:
- If the User is in breach any of the terms and conditions of this Agreement and/or the Terms of usage of Smartshoppers.in;
- If the User has provided wrong, inaccurate, incomplete or incorrect information;
- If Your actions may cause any harm, damage or loss to the other Users or Smartshoppers.in.
Illegal and/or unauthorized use of the Service, including unauthorized framing of or linking to the Smartshoppers.in Site and / or selling or offering for sale, products or services that infringe third party rights will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal and injunctive redress.
Indemnity:
User agrees to defend, indemnify and hold harmless btechguru.com, Services, its employees, directors, officers, agents and their successors and assigns from and against any and all claims, liabilities, damages, losses, costs and expenses, including attorney's fees, caused by or arising out of claims based upon the User's actions or inactions, including but not limited to any warranties, representations or undertakings or in relation to the non-fulfillment of any of User’s obligations under this Agreement or arising out of the User's infringement of any applicable laws, regulations including but not limited to Intellectual Property Rights, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights.
This clause shall survive the expiry or termination of this Agreement.
USER AGREEMENT
This document is an electronic record in terms of Information Technology Act, 2000 and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
These are the terms and conditions ("User Agreement") governing your use of the website www.btechguru.com (hereinafter referred to as "the Website"). These terms and conditions constitute your binding obligations towards Btechguru.com which is the website maintained and created by Bodhbridge Educational Services Private Limited (hereinafter referred to as "Btechguru.com").
For the purpose of the User Agreement, Registered User / and wherever the context so require 'You' shall mean any natural or legal person who has agreed to become a member/user of the Website by providing Registration Data (as defined hereinafter) while registering on the Website using the computer systems of the Website and accepted this electronic version / electronic record of the User Agreement and has allocated himself a unique identification user name ("User ID" and "Password").
As a new Registered User/member or visitor, this User Agreement shall be effective and binding upon your 'acceptance'. 'Acceptance' shall mean your affirmative action in clicking on 'check box' and on the 'continue button' as provided on the registration page. By accepting this, are legally liable to follow our:

Amendments: Btechguru may amend this User Agreement and/or other Btechguru.com Policies, Terms and Conditions at any time by posting a revised version on the Website. The revised version will be effective at the time Btechguru posts it on the Website. You are advised to regularly check for any amendments or updates to the terms and conditions contained in this User Agreement and in Btechguru.com Policies, Terms and Conditions. Such amendments can change the terms of this User Agreement or Btechguru.com Policies, Terms and Conditions that reduce your rights or increases your responsibilities.
By accepting this User Agreement, the User has also accepted and agreed to be bound by all Btechguru.com Policies as provided from time to time on the Website.
User Eligibility
Use of the Website is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. are not eligible to use the Website. If you are a minor i.e. under the age of 18 years, you shall not register as a member of the Website and shall not sell, purchase or bid for any items on the Website. As a minor if you wish to purchase or sell an item on the Website such purchase or sale may be made by your legal guardian or parents who have registered as users of the Website. btechguru reserves the right to terminate your membership and refuse to provide you with access to the Website if it is brought to btechguru’s notice or if it is discovered that you are under the age of 18 years.
Breach
Without limiting other remedies, Btechguru.com may limit your activity, warn other Users of your actions, immediately temporarily/indefinitely suspend or terminate your membership or Registration, and/or refuse to provide you with access to the Website in the event, but not limited to:
If you breach the User Agreement or Terms and Conditions or other Policies of Btechguru.com.
If Btechguru.com is unable to verify or authenticate any information you provide; or
If it is believed that your actions may cause legal liability for you, other Users or Btechguru.com.
Btechguru.com may at any time at its sole discretion reinstate suspended Users. A User that has been indefinitely suspended may not register or attempt to register with Btechguru.com or use the Website in any manner whatsoever until such time that such User is reinstated by Btechguru.com. Notwithstanding the foregoing, if you breach the User Agreement or Terms and Conditions or other Policies of Btechguru.com, Btechguru.com reserves the right to recover any amounts due and owing by you to and to take strict legal action including but not limited to a referral to the appropriate police or other authorities for initiating criminal or other proceedings against you.
No Warranty
Btechguru.com and its suppliers, affiliates and service provider provide the Website and services "as is" and without any Warranty or condition, express, implied or statutory and specifically disclaim any implied Warranties of title, merchantability, fitness for a particular purpose and non-infringement. You expressly agree that your use of the Website at your risk.
Limitation of Liability
In no event shall Btechguru.com or its suppliers, affiliates and service providers be liable for any direct, indirect, incidental, special, incidental, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses arising out of or in connection with the Website, its services or this agreement (however arising, including negligence).
Indemnity
You shall indemnify and hold harmless Btechguru.com and its officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys' fees, made by any third party or penalty imposed due to or arising out of your breach of the User Agreement, Terms and Conditions and other Policies of the Website, or your violation of any law, rules or regulations or the rights of a third party.
Governing Law
The User Agreement, Terms and Conditions or the Policies of the website be governed and construed in accordance with the laws of India

2. RIGHT TO COLLECT
By accepting the Terms of Service you agree that we may collect and store your Personal Information as long as you use our Services subject to the limitations set out in this Privacy Policy.
2.1 We collect your Profiling and Account Information for the following reasons:
(a) We need your identity details, contact details, banking information and account history to manage our relationship with you and provide Services to you. We will only disclose this information as per mutually agreed terms and condition.

We may under certain circumstances procure an element of the Services from a third party service provider. To the extent that it may be necessary, and solely for the purposes of providing the Service to you, you agree that we may disclose to such third party any of your Personal Information that may be necessary for the procurement of services from the third party.
4. CHANGES IN PRIVACY POLICY
From time to time we may make changes to our privacy policy If we make changes, we will post them on our site to make users aware of what the changes are so users will always be aware of what information we collect, how we use it, and when we may disclose it. A User is bound by any minor changes to the policy when she or he uses the site after those changes have been posted If, however, we are going to use users' personally identifiable information in a manner materially different from that stated at the time of collection we will notify by posting a notice on our Web site for 30 days.
Shipping policy for NPTEL Orders
We are committed to delivering your order accurately, in good condition, and always on time.
An order consists of list of Courses and the terms items and courses have been used below interchangeably. Sometimes an order can shipped partially in phases, in such cases the shipped part of the order is the list of courses/items sent and the unshipped part are the courses/items that are yet to be shipped.
I. Delivery mode:
We use EMS Speed Post to deliver the packages to your shipping address. As soon we ship the package, as a confirmation we send you the Speed Post number to your mail account. You can track your package using the EMS Speed Post tracking system using the following link:

II. Shipping time
We make our best efforts to ship all items in your order within 3 working days from the day of receiving confirmation of the payment of your order. However in some cases, we may take longer, up to 7 working days, to ship the order due to unavailability of an item. In the unlikely event that we are not able to ship your order completely within 7 days of the order, we shall inform you about the delay through email or phone, in such a case you can either seek a new item in its place or cancel the remaining unshipped part of the order, by sending an email to nptel.bodhbrigde@gmail.com. In such cases, your payment against the unshipped part of the order shall be refunded; in the manner you have made the payment. Please note that any such changes to your initial order has to be notified to us through the email id by which you have registered with us during the User Registration process. Such a communication through email is considered an electronic document and is valid as proof for resolving any conflicts that might arise.
Total Delivery time depends on the distance of your place from Chennai. Please wait for at least a week from the shipping date before the packet can reach you. You can track the packet from with the Speed Post number which has been given to you.
III. Shipping Address
The Shipping Address is where a customer wishes to receive his order. It could be his home, office or any valid address. Every time you place an order you have the option of choosing the shipping address. Please take extra care in giving us the right shipping address, provide us with your Pincode and mobile/phone number that can help the deliver people. In case of the packet returns back to us due to any error in shipping address, we will communicate the same to you and your can give us your correct address by email. Such a change in shipping address has to be notified to us through the email id by which you have registered with us during the User Registration process. Such a communication through email is considered an electronic document and is valid as proof for resolving any conflicts that might arise.

V. Refund and Cancellation Policy.
I. Change in Order request will be taken by e-mail, only when your packet is not physically dispatched. Please note that any such changes to your initial order has to be notified to us through the email id by which you have registered with us during the User Registration process. Such a communication through email is considered an electronic document and is valid as proof for resolving any conflicts that might arise out of..
II. Orders once placed cannot be cancelled or refunded in circumstances such as:.
a.In case of a damaged item (course) you must contact us and end us back the packet and on our verification of the faultiness of the item (course), we will surely send a new copy of the same item, but in such cases we cannot cancel or refund the order..
b.In case of an error with respect to the item in the packet, you can contact us and on verification of an error, we will take the necessary action to rectify the error..
III. Refund and Cancellation are strictly limited to the following conditions..
a.If the item (course) requested is not available with us..
b.In the unlikely event that we are not able to ship your order completely within 7 days of the order, we shall inform you about the delay through email or phone, in such a case you can either seek a new item in its place or cancel the remaining unshipped part of the order, by sending an email to nptel.bodhbrigde@gmail.com.
